ABSTRACT
The pollution of the Environment occurs daily with the activities of man. The rule created in Rylands v Fletcher of 1868 is one of strict liability and it is applicable in the control of environmental pollution. The findings of this work are that the rule as seen in different cases both in Nigeria and other Jurisdictions helps to fight environmental pollution, however it is found lacking in some situations as discussed in this work. The methodology undertaken entails sourcing of materials from the library, internet, journals etc and this helped to give the Legal structure, Legal framework and case laws that exist to solve the problems of Environmental pollution.. The advice this work provides is that the rule should be modified to suit the modern world. This work discussed the hazards caused by Environmental pollution, the rule and doctrine in Rylands’, mechanisms for Environmental reform, application of rule in different countries.
